WARRANTY Equaris of Minnesota, Inc. warrants the Equaris Separation and Wastewater Treatment Systems against defects in materials and workmanship, under normal use, operation and maintenance for a minimum period of five (5) years and a maximum period of the life of the structure in which they may be installed. This Warranty is a full warranty effective for the above aforementioned designated warranty period of time from the date of installation, covering design, labor, and material costs to remedy failure to meet performance expectations for Equaris Systems used and installed in accordance with the Equaris System's Installation and Maintenance Manuals. EXCEPTIONS: All plumbing fixtures, such as toilets and sinks, plumbing piping, and all electrical components installed or associated with the Equaris System are warrantied by their respective manufacturer and their warranties are provided to the customer when purchased and installed with the Equaris System. PURCHASER'S OBLIGATION: Purchaser must use and maintain the Equaris unit(s) strictly in accordance with their respective Installation and Operation Manual's instructions. Any claim under this Warranty must be submitted in writing to Equaris of Minnesota, Inc. prior to the expiration of the warranty period, provided such claim is made within thirty (30) days of discovery of any defects covered by this Warranty. Equaris OF MINNESOTA, INC.'S OBLIGATION: Shall it be determined that a valid Warranty Claim has been submitted, Equaris of Minnesota, Inc. shall correct the defects by suitable replacement or repair at Equaris of Minnesota, Inc.'s expense. Any replaced or repaired component(s) will carry a further Warranty on the same terms as set forth herein starting from the date of replacement or repair. EXCLUSIONS: THE FOLLOWING ARE EXCLUDED 1. Any repair(s) or replacement(s) necessitated by failure to conform to the Equaris System's Operation and Maintenance Manuals. 2. Any repair(s) or replacement(s) necessitated due to vandalism, neglect, abuse, misuse or failure to adequately service the unit(s) in accordance with the Equaris System's Operation and Maintenance Manuals. OTHER WARRANTIES: This Warranty is in lieu of and excludes all other warranties expressed or implied by operation of law or otherwise. Equaris of Minnesota, Inc. neither assumes nor authorizes any representative or other person to assume for it any obligation or liability set forth herein. The remedies provided herein shall be the customerís sole remedies for breach of any warranty. Equaris of Minnesota, Inc., shall not be liable in contract or in tort to the customer or any other person for special, indirect, or consequential damages, such as, but not limited to, damage to, loss of or loss of the use of, other property or equipment, loss of profits or revenues, or claims of customers or tenants of the customer for service interruptions or losses of any kind. |
